Terms of Service
The rules that govern access to Evy, event publishing and use of our community features.
Agreement to these Terms
These Terms of Service (“Terms”) govern your access to and use of Evy, including the Evy mobile applications, website, browser version and related services (collectively, the “Service”). The Service is operated by Eshap – Agence de communication Sàrl (“Evy”, “we”, “us” or “our”).
By accessing or using the Service, creating an account, publishing an event or otherwise interacting with Evy, you agree to these Terms and to our Privacy Policy and Community Guidelines. If you do not agree, do not use the Service.
What Evy provides
Evy is a platform for discovering, publishing, saving, sharing and discussing events. Public event information may be browsed without an account. An account is required for interactive features such as publishing events, saving favourites, participating, messaging, commenting, reporting content or managing a profile.
Evy provides the technical platform only. Unless we expressly state otherwise, we are not the organiser, seller, venue, promoter, ticketing provider or contractual party for events published by users.
Eligibility and age
You must have the legal capacity to accept these Terms under the laws applicable to you. If you are a minor, you may only create and use an Evy account with the permission and supervision of a parent or legal guardian. By creating an account, you confirm that you satisfy these requirements.
Accounts and security
Accounts are created using an email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity carried out through your account. You must promptly notify us at info@myevy.app if you suspect unauthorised access.
You may not impersonate another person, create an account using misleading information, sell or transfer your account, automate account creation, or use another person’s account without permission.
Publishing and attending events
Any eligible account holder may publish an event. Publishers and organisers are solely responsible for ensuring that event information is accurate, lawful and up to date, including the date, location, price, ticket link, capacity, accessibility information, safety requirements, age limits, licences and cancellation terms.
Organisers must have all rights, licences, permissions, consents and authorisations necessary to publish the event and any associated images, photographs, videos, logos, trademarks, music, descriptions, promotional materials or links. Where identifiable persons appear in submitted content, the organiser is responsible for obtaining any consent or authorisation required by applicable law.
Organisers must clearly disclose material changes, cancellations and any conditions affecting attendees.
Users decide independently whether to attend an event. You are responsible for reviewing the organiser’s terms, venue rules, ticketing conditions, safety information and suitability of an event before attending.
User content, third-party rights and licence
“User Content” includes event listings, profile information, usernames, images, photographs, videos, messages, comments, reviews, links, reports, descriptions, logos, promotional materials and any other material submitted, uploaded, transmitted, published or otherwise made available through Evy. You retain ownership of your User Content.
By submitting or making User Content available through Evy, you grant Evy a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, format, adapt, translate, display, communicate, distribute and otherwise process that User Content solely as reasonably necessary to provide, operate, secure, moderate, improve and promote the Service and the relevant content, profile or event.
This licence allows Evy to make User Content available to other users through the Service and, where relevant to the operation or promotion of Evy or an event, through Evy-operated websites, applications and promotional channels. Evy does not acquire ownership of your User Content.
Your responsibility for content
You represent and warrant that you own your User Content or have obtained all rights, licences, permissions, releases and consents necessary to submit it to Evy and to grant Evy the licence described above.
In particular, you must ensure that your User Content does not infringe or unlawfully use any third party’s:
- copyright or related rights;
- trademarks, trade names, logos or other brand rights;
- image, publicity or personality rights;
- privacy or data-protection rights;
- contractual or confidentiality rights; or
- any other intellectual-property or proprietary rights.
You must not upload photographs, videos, artwork, music, logos, promotional material or other content copied from the internet or another source unless you have the legal right or permission necessary to use and publish it through Evy.
You are responsible for the content you publish. Evy providing the technical ability to upload or display content does not mean that Evy has verified, approved or obtained rights to that content on your behalf.
Copyright and rights complaints
If you believe that content available through Evy infringes your copyright, trademark, image rights, privacy rights or other legal rights, you may report the content through the reporting tools available in the Service or contact us at info@myevy.app. Please provide sufficient information to identify the content concerned, explain the rights you believe are affected and allow us to assess the request.
We may remove or restrict access to User Content where we reasonably believe it infringes third-party rights, violates these Terms or our Community Guidelines, or where removal is required by applicable law. Where appropriate, we may request additional information before acting on a complaint.
End of licence and retention
The licence granted to Evy generally ends when the relevant User Content is deleted from the Service or when your account is deleted. However, copies may remain for a limited period where continued retention is technically necessary for backups, legally required, necessary for security or fraud prevention, reasonably required to investigate reports or disputes, or otherwise permitted under our Privacy Policy and applicable law.
Prohibited conduct
You must not use Evy to:
- publish false, fraudulent, deceptive, cancelled or non-existent events;
- harass, threaten, exploit, discriminate against or impersonate others;
- promote illegal activity, violence, hate, dangerous goods, scams or unauthorised gambling;
- share sexual exploitation material, non-consensual intimate content or content involving the sexualisation of minors;
- send spam, manipulate engagement, scrape data, introduce malware or interfere with the Service;
- collect personal data without a lawful basis or disclose private information without permission;
- circumvent safety, moderation, access-control or rate-limit measures;
- infringe copyrights, trademarks, image rights, privacy rights or other third-party rights.

Moderation and reports
Evy may use automated systems, including artificial-intelligence-assisted tools, to detect potentially harmful, unlawful or policy-violating content. Automated signals may be reviewed by a human where appropriate. Users may report events, profiles, messages, comments and other content.
We may restrict visibility, remove content, issue warnings, limit features, suspend or terminate accounts, preserve evidence, or report matters to competent authorities when reasonably necessary. This includes content that may infringe copyright, trademarks, image rights, privacy rights or other third-party rights. Moderation is context-dependent and we do not guarantee that every violation will be detected or removed immediately.
You may contact us if you believe a moderation decision was made in error.
Evy intellectual property
The Service, including its software, interface, brand, logo, visual identity, databases and original content, is owned by or licensed to Evy and is protected by applicable intellectual-property laws. These Terms give you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service for its intended purpose.
You may not copy, reverse engineer, decompile, resell, frame, mirror or create derivative products from the Service except where applicable law expressly permits it.
Third-party services and links
Evy may display links to ticketing platforms, organiser websites, maps, social networks or other third-party services. Third parties operate under their own terms and privacy practices. We do not control and are not responsible for their availability, security, content, pricing, transactions or conduct.
A link appearing on Evy does not constitute endorsement. Exercise caution before sharing information or making a payment outside Evy.
Changes and availability
We may modify, update, suspend or discontinue parts of the Service to improve functionality, security or compliance. We do not guarantee uninterrupted or error-free availability, compatibility with every device, permanent storage of User Content, or that every feature will remain available.
Account deletion, suspension and termination
You may delete your account from within the Evy application. You may also use our account deletion page. Deletion is subject to limited retention described in our Privacy Policy.
We may suspend or terminate access where we reasonably believe that you have violated these Terms, created risk or legal exposure, harmed users or the Service, infringed third-party rights, or where required by law. Where appropriate, we may provide notice and an opportunity to appeal, but immediate action may be taken for serious safety, fraud or legal concerns.
Event and service disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. Event information and User Content are primarily supplied by users and organisers. Evy does not guarantee the identity, reliability or conduct of users; the accuracy, legality, quality, accessibility, safety or occurrence of an event; the ownership or legality of User Content; ticket availability; or the actions of organisers, venues or attendees.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded, including mandatory consumer rights.
Limitation of liability
To the maximum extent permitted by applicable law, Evy and its directors, employees and contractors will not be liable for indirect, incidental, special, punitive or consequential loss, loss of profit, reputation, data or opportunity arising from the Service, third-party services, event cancellation, attendance, user conduct, User Content or unauthorised account access.
Where liability cannot be excluded, it is limited to the extent permitted by law. Nothing excludes liability for intent, gross negligence, death or personal injury where exclusion is prohibited, or any other liability that cannot legally be limited.
Your responsibility to Evy
To the extent permitted by law, you agree to compensate Evy for reasonable losses, claims, damages, liabilities and costs resulting from your unlawful use of the Service, your event, your User Content, your infringement of third-party rights, or your material violation of these Terms. This obligation does not apply to the extent a loss was caused by Evy.
Governing law and disputes
These Terms are governed by Swiss law, excluding conflict-of-law rules. Courts at the registered office of Eshap – Agence de communication Sàrl have jurisdiction, subject to any mandatory consumer venue or other non-waivable rights available under applicable law.
Before starting formal proceedings, we encourage you to contact us so that we can try to resolve the issue informally.
Changes to these Terms
We may update these Terms when the Service, our practices or legal requirements change. We will publish the revised version and update the date above. Where changes materially affect your rights, we will provide reasonable notice through the Service or by email where appropriate. Continued use after the effective date constitutes acceptance of the revised Terms.
